1715.03 PERMITS.
   (a)    Required. No food establishment shall be operated in the City Health District without a permit from the Board of Health. Such permits shall be displayed in a conspicuous place in the food establishment.
   All permits issued by the Board of Health to operate a food establishment shall expire on December 31, following the date of issuance.
   No permits will be required for establishments selling only fresh fruit and vegetables on the premises where grown.
   (b)    Fees. An annual fee shall be paid at the time of making application for the permit. The fee shall be as follows and shall be based upon the total square feet of floor space required where food or drink is prepared, processed, manufactured, packaged, stored, sold or offered for sale at retail or wholesale.

   (c)    Establishments Located Outside City Doing Business in City. When a food establishment wishes to do business in the City Health District and is located outside the jurisdiction of the City Health District, the Board of Health shall reciprocate with the Health Department having jurisdiction at the point of origin; provided that such Health Department is conducting a comparable food protection program and that the Health Department responsible for that program will so certify to the Board of Health. If such a comparable food protection program is not conducted at the point of origin, a food establishment located outside the City before doing business in the City shall secure a food establishment permit as provided in subsection (a) hereof.
   The inspections by the Board of Health of the food establishments doing business in the City and located outside the jurisdiction of the Board of Health not under an approved food establishment program shall be paid for at the rate of twenty-five dollars ($25.00) per inspection and current labor contract rate per mile to and from the location plus lodging and meals.
   (d)    Application. During the month of December of each year every operator of a food establishment proposing to operate a food establishment during any part of the next year shall apply for a permit from the Board of Health.
   Any person, firm, association or corporation who, subsequent to January 1 of any year, proposes to operate a food establishment during any remaining part of the year shall apply for a permit from the Board of Health not less than ten days before the food establishment is to be opened for business.
   (e)    Issuance. On or before January 1 of each year, every operator of a food establishment proposing to operate a food establishment during any part of the year shall procure a permit from the Board of Health.
   Any person, firm, association or corporation who, subsequent to January 1 of any year, proposes to operate a food establishment during any remaining part of the year shall procure a permit from the Board of Health before the food establishment is opened for business.
   (f)    Revocation or Suspension. A permit to operate a food establishment may be suspended or revoked by the Board of Health upon violation by the holder of any of the terms of these regulations. However, such suspension or revocation shall not take place until the licensor has first notified such permittee in writing, called specific attention to the violation and afforded a reasonable time and opportunity to make satisfactory corrections.
