1715.02 GENERAL PROVISIONS.
(a) Right of Health Department Employees To Enter Premises. No person shall refuse to allow any duly authorized employee of the Health Department in the official discharge of his duty to enter any food establishment and shall not interfere with or obstruct such employee and shall not refuse a sample of food offered for sale upon the request therefor and the tender of the val us thereof.
(b) Police Powers of Inspectors. For the purpose of carrying into effect and enforcing the law and ordinances of the City now in force, or that may from time to time hereafter be enacted, the food inspector is hereby invested with the power of a police officer and may arrest on view or with warrant and bring forthwith before the judge of the Municipal Court, any person violating any of the State laws or the ordinances of the City.
(c) Obstructing Inspector in his Duties. Every person who resists, hinders, or obstructs the inspector in the lawful duties imposed upon him by the laws of the State, or the ordinances of the City, shall be punished as hereinafter provided.
(d) Sale of Unwholesome or Unapproved Food Prohibited. No person shall sell, offer for sale, or have in his possession with intent to sell any unwholesome food or keep or hold any food contrary to the provisions of this chapter. No person shall sell, offer for sale or have in his possession with intent to sell food of any kind, unless the same is approved by the State Department of Health or by the Commissioner of Health of the City.
(e) Confiscation and Destruction of Unwholesome Unapproved Food: Liability for Damages. The inspectors of the Health Department are authorized and directed to immediately confiscate and destroy such food referred to in the preceding such section and if done in good faith shall not be held liable for damages arising therefrom.
(f) Unwholesome Meat, Fish, Poultry and Game. No person shall bring into this City or sell or expose or offer for sale in any market, public or private, any cattle, sheep, swine or lamb, or any meat, fish, game or poultry that is unwholesome or any that have died of disease or accident, or that is for any reason unfit for human food.
(g) Meat, etc. Transported Through Streets To Be Covered. The body of any animal or fowl or part thereof which is to be used for food shall not be carted or carried through the streets or avenues of the City unless it is so covered as to protect it from contamination.
(h) Swine Lungs Not To Be Used For Food. Lungs from swine shall not be offered for sale or used for human food.
(i) Sale of Meat. etc. From Vehicles Prohibited. No person shall sell meat, fish or poultry of any kind at retail from trucks, wagons, pushcarts or any other vehicle.
(j) Vehicles Used for Transporting Food. All vehicles used for the transportation of any food shall be kept in a clean and sanitary condition at all times. All meat or meat food products shall be hauled or delivered in enclosed trucks or other closed vehicles. Open trucks or vehicles shall not be used for hauling or delivering any food products. No live animals shall be hauled or delivered with meat carcasses or other food products. Vehicles delivering refrigerated or frozen foods must have mechanical refrigerating equipment capable of maintaining temperatures of 45° and 0° respectively in the storage compartments.
(k) Delivery of Milk, Baked Goods, Other Foods. No person shall deliver to any place of business any milk, baked goods or other articles of food and leave such articles exposed on the doorstep or sidewalk. Receptacles that will protect such articles from contamination shall be provided at each place of business by the operator of the establishment.
(l) Sale of Meats, etc. Containing Harmful Substances. No person shall sell or offer for sale any meat, meat products, meat food products, fish, game or poultry containing any harmful substances prohibited by federal or State laws, nor shall any meat products, meat, meat food products, fish, game or poultry be sold or offered for sale which contains any substances used to change its color or appearance for the purpose of disguising the quality or making it appear of better quality than it is.
