932.25 EMERGENCY SUSPENSION OF SERVICE AND DISCHARGE PERMITS.
   The District by and through its Deputy Director, or other duly authorized representative, may, for good cause shown, suspend the wastewater treatment service, the wastewater discharge permit of a discharger and/or terminate water service when it appears that actual or threatened discharge presents or may present an imminent or substantial danger to the health or welfare of persons, substantial danger to the environment, interfere with the operation of the POTW or violate any pretreatment limits imposed by this Code or any wastewater discharge permit issued pursuant to this Code. Written notice of such suspension shall be served upon the discharger by personal service. Any discharger so notified of the suspension of the District's wastewater treatment service and/or the discharger's wastewater discharge permit, shall within a reasonable period of time as determined by the District, cease all discharges. In the event the discharger fails to comply voluntarily with the suspension notice within the time specified therein, the District shall, without further notice to the discharger and without the scheduling of a show cause hearing, immediately commence judicial proceedings to compel the discharger's compliance with such suspension notice and to exact civil penalties, if any, which may be due for or as a result of the discharger's noncompliance. The District may reinstate the wastewater discharge permit and/or the wastewater treatment service and terminate any judicial proceedings pending upon submission of written proof by the discharger that it has eliminated the noncomplying discharge or conditions creating the threat of imminent or substantial danger as set forth above.
   Where the Deputy Director or other duly authorized representative of the District finds that the emergency nature of the problem created by the discharge requires immediate emergency suspension of service and discharge permit, then such action shall be taken without prior notice. Notice of the District's action shall be served upon the user within the shortest reasonable time following the emergency action. (Ord. 92-206. Passed 4-29-92.)
