905.01 TRANSPORTING MATERIALS OVER PAVED STREETS.
No contractor or builder shall transport earth, construction equipment or materials incidental to construction, over any paved street of the City without first making a cash deposit with the Engineering Commissioner as hereinafter provided.
Before any contractor or builder transports earth, construction equipment or materials incidental to construction, over any paved street, he shall deposit with the Commissioner of Engineering, cash, in an amount not exceeding 1/10th of one percent (.10%) of the total amount of the contract price, but in no event shall the deposit be less than two hundred dollars ($200.00) nor more than five thousand dollars ($5,000), as a guarantee that the contractor or builders will clean and/or repair any damage which may occur to City streets because of the hauling of such earth, construction equipment or materials incidental to construction. In each case the contractor or builder fails to clean or repair the street to the satisfaction of the Engineering Commissioner or his duly designated assistant, then the City, by and through its Engineering Commissioner, shall repair and clean the street and deduct the cost of such work from the moneys so deposited as herein required and return the balance remaining, if any, to the contractor or builder making the deposit.
