760.04 REGULATIONS.
   (a)   Regardless of whether an appropriate permit has been obtained from the Chief of the Division of Oil and Gas of the Ohio Department of Natural Resources, pursuant to Ohio R.C. Chapter 1509 and/or the City Engineer or his designee, pursuant to this chapter, no person, firm or corporation shall:
      (1)   Engage in site preparation or drilling rig erection activities at hours other than those permitted by the City Engineer or designee; and
      (2)   Fail to use the approved access route for ingress and egress to the activity site indicated on the permit issued by the City Engineer or his designee.
   (b)   No person, firm or corporation shall drill, construct, reopen, convert, plug back, plug, use, operate, maintain, repair, abandon or remove waste materials from any oil or gas wells within the limits of the City in such a manner as to be injurious or dangerous to the health, safety, welfare or property of individuals.
   (c)   There shall be no remaining contaminated land surrounding the well-head. The procedure to insure this requirement shall be as follows:
      (1)   The top soil within 100 feet from the well-head shall be removed and temporarily stored on site.
      (2)   The containment trench shall be lined as required in the Ohio Administrative Code.
      (3)   After use of brine and other liquid is completed and disposed of, the original topsoil shall be replaced in its former location.
   (d)   The distance from the well equipment and its appurtenances to any inhabited structure shall be 200 feet.
