731.06 LICENSE DENIAL AND REVOCATION.

   (a) The application for a bench license shall be denied if the Engineering Commissioner finds that the maintenance of the bench would tend to obstruct passage along any public way, or to create a hazard, or would otherwise be detrimental to the public safety, welfare and convenience.

   (b) Any license may be revoked, or renewal thereof denied, for violation of any provision of this chapter, for any fraud or misrepresentation in the application, or for any reason which would have been grounds for the denial of the application.

   (c) Any license issued under this chapter shall be cancelled and revoked if the licensee fails to install the bench within sixty days after the date of the issuance of the license.

   (d) The application shall be cancelled and denied or the permit revoked, as the case may be, if sixty percent (60%) of the property owners and persons in lawful control or having their places of business within 200 feet of the location of the bench or benches protest the location of the same.
