727.08 CONFLICT; DUTY OF CARE.
   (a)   If any clause, sentence, paragraph or part of this chapter, or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction to be unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainder of this chapter and the application of such provisions to other persons or circumstances, but shall be confined in its operation to the controversy in which such judgment shall have been rendered and to the person, firm, corporation or circumstances involved. It is hereby declared to be the legislative intent of this body that this chapter would have been adopted had such invalid provisions not been included.
   (b) In the event of a conflict between any provision of this chapter and any other ordinances, the provisions of this chapter shall prevail with the exception of ordinances whose standards are more restrictive than those set out in this chapter.
   (c)   Sections 727.02 and 727.04 create a duty of reasonable care in all suppliers in actions with consumers covered by this chapter. (Ord. 89127. Passed 4-2-75.)
