521.99 PENALTY.

Whoever violates Section 521.08(b) or (c) is guilty of an unclassified misdemeanor, punishable by up to six months incarceration and a fine of up to one thousand dollars ($1,000) or both. The willingness of the defendant to perform community service in the Litter Control Department may be considered as a mitigating factor in sentencing. The Court shall require the offender to pay restitution to the City for the cost of the removal or abatement of the nuisance and cleanup of the site where the offense occurred, if the City has performed the function.
