Any person who violates any provision of this chapter shall be guilty of an infraction and, upon conviction, shall be punishable by (1) a fine not exceeding Fifty and no/100ths ($50.00) Dollars for a first violation; (2) a fine not exceeding One Hundred and no/100ths ($100.00) Dollars for a second violation of this chapter within one year; and (3) a fine not exceeding Two Hundred Fifty and no/100ths ($250.00) Dollars for each additional violation of this chapter within one year. A person who violates the provisions of Section 5-18.03 of this chapter shall be deemed guilty of a separate offense for each day, or portion thereof, during which the violation continues. A person who violates the provisions of Section 5-18.04 of this chapter shall be guilty of a separate offense for each item of drug paraphernalia which is distributed. (§ 1, Ord. 908, eff.
