(a) It shall be unlawful for any person to smoke any cigarette or other substance, or strike any match, or kindle any flame whatsoever within the fenced area of the Port of Sacramento, including vessels moored to the Port’s facilities, except within offices and those areas designated “SMOKING AREA.”
(b) Any person violating any of the provisions set forth in subsection (a)of this section shall be guilty of a misdemeanor. Any person convicted of a misdemeanor under the provisions of this section shall be punishable by a fine of not more than Five Hundred and no/100ths ($500.00) Dollars, or by imprisonment in the County Jail for a period not exceeding six (6) months, or by both such fine and imprisonment.
