1177.07 RESTORING NONCONFORMING USE OR STRUCTURE.
   (a)   A nonconforming building in any district that is partially destroyed or damaged, exclusive of the foundation, to an extent less than fifty percent (50%) of its reproduction value at the time of damage, by fire, flood, earthquake, explosion, war, riot or act of God or act of the public enemy may be restored and the use of the building resumed in accordance with the other provisions of this chapter; provided that the restoration and resumption shall take place within eighteen months of the time of such damage or destruction.       (b)    A single-family residence on a nonconforming lot in any zoning district that is destroyed or damaged to an extent greater than fifty percent (50%) of its reproduction value at the time of damage, by fire, flood, earthquake, explosion, war, riot or act of God or act of the public enemy may be restored or replaced with another single-family residence even though all requirements of Section 1151.04 (d), 1153.04 (d), 1155.04 (d), 1159.05 (d) (1), or 1163.05 (d) are not met.
   (c)    When five or more single-family residences on non-conforming lots in any zoning district are destroyed or damaged to an extent greater than fifty percent (50%) of their reproduction value at the time of the damage, by a single event such as fire, flood, earthquake, explosion, war, riot, or act of God or act of the public enemy, such homes may be restored or replaced with other single-family residences even though the requirements of Sections 1151.04 (a) to 1151.04 (d), 1153.04 (a) to 1153.04 (d) and 1155.04 (a) to 1155.04 (d) are not met provided the homes are rebuilt substantially the same as they were prior to the damage.
      (1)    This waiver of area, dimensional requirements of the lot, and the dimensional setback requirements shall apply to the lot and the main residential structure as they legally exist at the time of the damage to the residence, and all other requirements of Chapters 1151, 1153 or 1155 must be met.
