1177.05 CHANGING NONCONFORMING STRUCTURE.
   (1)    Except as provided in Section 1177.05 (2) hereof, no existing building or premises devoted to a use not permitted by the Zoning Code in the district in which the building or premises is located, except when required to do so by law or ordinance, shall be enlarged, extended, reconstructed, or structurally altered unless:
      (a)   Such use is changed to a use permitted in the district in which such building or premises is located or to a more restrictive use although such use may not be permitted in the zoning district in which the property is located;
      (b)   Such enlargement, structural alteration or change in use is approved pursuant to Section 1133.04.
   
   (2)    When an existing non-conforming residential building containing six or fewer dwelling units is enlarged, extended, reconstructed, or structurally altered and the number of dwelling units is not increased, it shall not be required to be changed to a more restrictive use provided that any Development Plan filed in accordance with Chapter 1133 of the Code as required, shall be reviewed by the Architectural Review Board whether submitted as a Development Plan or a Development Plan Exemption, and provided further that no such Development Plan shall be approved unless all other district regulations are met.
