1133.04 DEVELOPMENT PLAN EXEMPTION.
   A Development Plan Exemption may be granted by the City Manager, if after reviewing the application required herein, the City Manager determines in writing that the proposed construction, structural alterations or change in use conforms in all respects with the Zoning Code, has little or no physical or visual impact on the surrounding neighborhood, and meets the conditions set forth in Section 1133.06(b)(2)A., B. and C. Where there is an enlargement, structural alteration or change in use to a nonconforming structure or use which otherwise meets the requirements of Section 1133.06(b)(2)A., B. and C.and has little or no physical or visual impact on the surrounding neighborhood, a Development Plan Exemption may be granted by the City Manager when the enlargement, structural alteration or change in use creates a more restrictive nonconforming structure or use. Alternatively, the City Manager may refer the application to the Planning Commission for its recommendation to the City Manager and/or to the Architectural Review Board for its recommendation to the City Manager. If the City Manager rejects an application for a Development Plan Exemption, the owner may submit a Development Plan application to the Planning Commission.
