(a) (1) As the representative of the Planning Commission, the City Manager may approve a proposed division of a lot, lot of record, parcel, or tract of land provided the proposed division complies with the following and:
A. Fronts an existing public street;
B. Does not involve the opening, widening or extension of any street or road;
C. Creates no more than five lots after the original lot, lot of record, parcel or tract has been completely subdivided; or
D. Promotes the transfer of an existing parcel of property from one property owner to another for purposes of redefining the boundaries of the lots or lots of record, or the proposed reconfiguration of an existing lot, lot of record, parcel, or tract of property;
E. Is in compliance with the applicable provisions of the Planning and Zoning Code and Subdivision Regulations;
F. Whose gross area is less than ten acres.
(2) Any proposed division of a tract of land whose area is in excess of ten acres shall be referred to the Planning Commission regardless of the number of lots created or whether or not such proposal otherwise conforms to the provisions of the Zoning Code.
A. The applicant shall submit a plat of survey and corresponding legal descriptions for all lots, lots of record, tracts, or parcels that will be created or reconfigured by the proposal which plat or plats shall be prepared by a qualified professional surveyor, who shall be licensed to practice in the State of Ohio and whose stamp shall be embossed on such plat or plats.
(b) The survey plat shall clearly show the proposed lot lines, including the distances and bearings; the total land area of the lots exclusive of any rights-of-way; the location and a description of any easements, the location of any and all buildings, structures, and other improvements and their setbacks from all property lines, the principal average width and the principal average depth of all lots; and all other information typically contained on such a survey plat. The plat of survey shall be certified by the surveyor to the City of Wyoming to be true and accurate.

(d) If, after considering the recommendation of the Community Development Director, the City Manager is satisfied that such proposed division is not contrary to applicable platting, subdividing, and/or zoning regulations, the City Manager shall within seven working days after submission of such proposed division approve the same, and shall stamp the plat "Approved by Wyoming Planning Commission" provided however that the City Manager may refer any such request to the Planning Commission if in the sole reasonable opinion of the City Manager, the proposal may have an adverse impact on the surrounding neighborhood or create traffic hazards or other safety concerns. Referrals to the Planning Commission shall be in accordance with Section 1115.10(d)(1) and 1115.11 hereof. (Ord. 24-2020. Passed 12-14-20.)
(1) If the City Manager has a question as to whether or not the proposed division conforms to the specific requirements or the intent of the Code, the application may be referred to the Planning Commission for consideration. Such subdivision request shall be placed on the agenda of the Planning Commission in as timely a manner as possible but shall allow for notice to be sent pursuant to Section 1115.11 hereof.
(2) If the City Manager refuses to grant administrative approval for subdivision, the applicant may appeal to the Planning Commission.
