§ 112.004 VEHICLES, STREETS AND THE LIKE.
   (A)   It is unlawful for any person to scatter or distribute on or along any public street or municipally-owned parking lot or place or cause to be placed on or in any motor vehicle on any public street or municipally-owned parking lot in the city any commercial literature, advertising material, commercial handbill, card, sample or other matter for the purpose of advertising. The provisions of this section shall not apply to the advertising material of religious, fraternal or charitable organizations.
   (B)   Any person who advertises his or her goods, wares or merchandise by causing any advertising material to be scattered or distributed in any manner contrary to the provisions of this section shall be subject to the penalties provided in this code applicable to this subchapter in the same manner as the person who actually distributes any advertising material.
