(A) Required. It shall be unlawful for any person to engage in business as a peddler or transient merchant in the city without first having obtained a license from the Clerk. Any person, partnership, corporation or two or more persons having a joint or common interest seeking a peddler or transient merchant license in the city shall make written application to the City Clerk stating the applicant’s name, residence, federal taxpayer identification number, state employer identification number and, if said applicant is seeking a transient merchant license also at the same time, deposit $1,000 with the City Clerk or file a surety company bond for that amount.

(B) Fee. The annual fee for a license for a peddler, whether or not a truck or vehicle is used by said peddler, shall be $300. The fee for a transient merchant’s license shall be $300 per day.

(C) Tag. The City Clerk shall issue to a person licensed pursuant to this section two tags which shall bear the license number and the following words “Peddler’s License, City of Wyandotte”. The licensee shall display such a tag on each side of any vehicle used in the conduct of his or her business.

(D) Exemption.
(1) The following shall be exempt from the provisions of this section:
(a) Any person selling vegetables, eggs, fruits and farm products of any kind or description which have been raised or produced by him or her, or which are being sold from an area which has been specially designated by Council resolution as a farm products sales area, and to which area such person has been granted access by the council after written request to the Council for such access;
(b) Any mechanic selling any article of his or her own invention; and
(c) Any person selling goods, wares and merchandise manufactured by him at any store, city market, refreshment stand or booth at fair grounds or by going about from place to place in the city.
(2) To be entitled to this exemption a person must make an affidavit to such effect to the City Clerk. Upon receipt of such an affidavit, the City Clerk shall issue a certificate of exemption stating that its holder is exempt from the provisions of this subchapter.
