§ 94.064 INSPECTOR; DUTIES AND POWERS.
   (A)   The inspector shall be responsible for the enforcement of this subchapter and the regulations promulgated thereunder and his or her duties shall, among others, be as follows:
      (1)   To investigate complaints, including complaints about air pollution, make observations of smoke and air pollution conditions and take the necessary action to abate nuisances therefrom;
      (2)   To issue permits, and notices, and to keep records of applications, plans, specifications, permits, violations, complaints and other matters on file for Department purposes only;
      (3)   To examine the plans and specifications for all new buildings and alterations of or repairs to existing buildings for the purpose of ascertaining that such buildings when erected, altered or repaired will meet the requirements of this subchapter;
      (4)   To examine the plans and specifications for the erection, construction, reconstruction, installation, alteration or repair of fuel-burning equipment and inspect such work and issue permits, all as required in accordance with the provisions of this subchapter;
      (5)   To publish and disseminate information on methods of smoke and air pollution reduction; and
      (6)   To enlist the cooperation of civic, technical, scientific and educational groups, societies and organizations in respect to the reduction and abatement of smoke, air and other atmospheric pollution.

   (B)   The inspector may, at reasonable hours enter upon any property, except dwellings, to inspect same for the purposes of this subchapter. The inspector may require the owner, occupant, manager or agent of any property to make such tests of or alterations in fuel-burning equipment thereon or the manner of operating the same as may, in his or her opinion, be necessary to prevent or lessen the emission or discharge to the atmosphere of air contaminants or other solid or gaseous products of combustion. No person shall in any manner obstruct, hinder, delay, resist, prevent or in any way interfere or attempt to interfere with the inspector in the carrying out of his or her duties or refuse entry upon any property or premises at any reasonable time. Whenever compliance with the provisions of this subchapter creates undue hardship, the inspector may permit deviation from strict compliance with the provisions of this subchapter if the purpose of this subchapter is observed and not violated.
