(A) For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CABLE TELEVISION or CABLE TELEVISION SYSTEM. A communications system operating within the city which distributes cablecast, pay programs and/or other signals and/or services by means of coaxial cable or other state-of-the-art equipment installed on, over or under the public right-of-way in the city that is owned and operated by the Department of Municipal Service of the city.
CITY. The City of Wyandotte.
DEPARTMENT. The Department of Municipal Service of the city.
OPERATOR OF SUCH SYSTEM. The Department of Municipal Service of the city.
PERSON. Any individual, person, firm, partnership, association, corporation, company or organization of any kind.
PREMIUM TELEVISION OR PREMIUM CABLE TELEVISION. A show, channel or service for which a separate fee is charged such as pay television or security service.
(B) It shall be unlawful for any person to make any physical connection to the Department’s premium cable television system operating within the city that is not expressly authorized by the operator of such system.
(C) It shall be unlawful for any person to willfully damage, destroy, remove, obstruct or interfere with any part of the Department’s premium cable television system operating in the city without the express authorization of the operator of such system.
(D) It shall be unlawful for any person to make any modification to system equipment or to any system-connected equipment so as to induce any uncompensated premium cable television system service or level of service for which the operator has established a compensation rate without the express authorization of the operator of such system.
(E) It shall be unlawful for any person to obtain, by any means whatsoever, any cable television signal from any cable television system operating within the city without the express authorization of the operator of such system.
