(A) Refund of accumulated contributions.
(1) If a member leaves the employ of the city before both he or she has attained his or her applicable voluntary retirement age and he or she has acquired his or her applicable minimum credited service, for any reason, except his or her retirement or death, he or she shall be paid his or her accumulated contributions standing to his or her credit in the Annuity Savings Fund upon his or her request in writing filed with the Commission. Payment of his or her accumulated contributions shall be subject to division (A)(3) below.
(2) If a member dies and no retirement allowance or pension becomes or will become payable by the retirement system, except as provided in § 32.020 of this chapter, his or her accumulated contributions standing to his or her credit in the Annuity Savings Fund at the time of his or her death shall be paid to such person or persons as he or she shall have nominated by written designation duly executed and filed with the Commission. If no such designated person survives the member, his or her said accumulated contributions shall be paid to his or her estate. Payment of his or her accumulated contributions shall be subject to division (A)(3) below.
(3) The return of a member’s accumulated contributions, as provided in this section, shall be made in accordance with such rules and regulations as the Commission shall from time to time adopt.

(B) Refund of hospital member accumulated contributions. Each hospital member who is in the employ of the hospital on 3-8-1982, may request, on a form furnished by the hospital personnel office, a refund of the accumulated contributions standing to his or her credit in the Annuity Savings Fund. If such written request is not filed with the personnel office on or before 4-30-1982, the member’s accumulated contributions shall remain in the Annuity Savings Fund where they shall accumulate with regular interest and be subject to the provisions of division (A) above.
