§ 32.020 DUTY DEATH BENEFITS.
   (A)   If a member dies as the result of personal injury or disease arising solely and exclusively out and in the course of his or her employment by the city or a disability retirant dies, while in receipt of worker’s compensation on account of his or her city employment and prior to his or her attainment of his or her applicable voluntary retirement age, as the result of the same injury or disease for which he or she was retired and, in either case, the Commission finds that his or her death, injury or disease resulting in death is the result of his or her actual performance of duty in the employ of the city, the applicable benefits provided in this division (A) shall be paid, subject to the condition that worker’s compensation is granted on account of the member’s death.
      (1)   The member’ accumulated contributions standing to his or her credit in the Annuity Savings Fund at the time of his or her death shall be refunded in accordance with § 32.023(A)(2) of this chapter.
      (2)   The member’s widow shall receive a pension equal to his or her weekly worker’s compensation converted to an annual basis. The widow’s pension shall begin upon termination of his or her worker’s compensation period and shall terminate upon remarriage or death, whichever occurs first.
      (3)   Each unmarried child of the deceased member who is under the age of 18 years shall receive a pension equal to his or her weekly worker’s compensation converted to an annual basis. Each such child’s pension shall begin upon termination of his or her worker’s compensation period and shall terminate upon his or her adoption, marriage, death or attainment of age 18 years, whichever occurs first. If the widow’s pension is terminated on account of his or her remarriage or death, the pension of each child shall be increased by an equal share of the said widow’s pension.
      (4)   Each parent of the deceased member shall receive a pension equal to his or her weekly worker’s compensation converted to an annual basis. Each such parent’s pension shall begin upon termination of his or her worker’s compensation period and shall terminate upon his or her remarriage or death, whichever occurs first.
   (B)   As used in this section, the term WIDOW means the person to whom a member was married at the time his or her employment with the city last terminated. The term WIDOW shall include a widower whom the Commission finds to be totally and permanently disabled and to have been dependent upon the deceased member for at least 50% of his or her financial support.
