§ 177.999 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.999 of this code of ordinances.
   (B)   (1)   A person, individual, partnership, firm, corporation, organization, institution or agency of government that violates §§ 177.040 through 177.056 of this chapter is responsible for a civil violation and may be fined not more than $5,000. If a court determines the penalty as set forth in this division (B) is unlawful, then the fine shall be the maximum amount allowed by law.
      (2)   A person, individual, partnership, firm, corporation, organization, institution or agency of government that violates §§ 177.040 through 177.056 of this chapter may be ordered by the court to pay the costs to restore or replicate a resource unlawfully constructed, added to, altered, repaired, moved, excavated or demolished.
