§ 74.43 COMMERCIAL I AND II AND CONTRACTOR PARKING PERMITS.
   (A)   The Town Manager is authorized to implement a program for the issuance of commercial parking permits for businesses operating within the town. Such program shall be subject to the following restrictions:
      (1)   Commercial parking passes shall only be issued to employees of businesses located in an existing building that is surrounded in part by paid parking spaces.
      (2)   The owner or operator of each such business shall be entitled to purchase commercial parking permits.
      (3)   No more than ten commercial I parking permits shall be issued for one business location. The number of commercial I permits available for such business location (up to a maximum of ten) shall be determined by the Town Manager or his or her designee.
      (4)   The number of commercial II parking permits shall be determined by the Town Manager or his or her designee. Parking for holders of commercial II parking permits shall be restricted to the assigned parking area at the Town Hall complex in the vicinity of the office of the NC Coastal Federation located on Salisbury Street.
      (5)   The number of commercial I parking permits issued to a business location shall not exceed the total number of commercial parking permits issued to that business location in 2013. After calendar year 2019, the number of commercial I parking permits that any business may purchase shall be limited to the number of commercial I parking permits purchased by such business in the preceding calendar year. Provided that in no event may a business purchase more commercial I parking permits than it purchased in 2013.
      (6)   The fee to be paid for such permits shall be as established from time to time by the Board of Aldermen. Permits shall be effective for that portion of the calendar year that parking is regulated by meters.
      (7)   A vehicle properly displaying a current authorized commercial I permit shall be permitted to remain in a marked parking space without activating the meter or pay station. Provided that holders of commercial I parking permits may not park in off-street parking lots or in on-street parking spaces providing a maximum meter time of one hour or less. Provided further that holders of commercial II parking permits may only park in the area designated in division (A)(4) above.
   (B)   The Town Manager is authorized to implement a program for the issuance of parking permits to contractors doing business within the town. Such program shall be subject to the following restrictions:
      (1)   A contractor or subcontractor working on property located within the town limits of the Town of Wrightsville Beach shall be entitled to purchase contractor parking permits.
      (2)   Contractor parking permits are intended to allow contractors, subcontractors and their employees to only park for the duration of the work that they are performing within the town limits of the Town of Wrightsville Beach.
      (3)   The number of permits issued for any one construction location and the duration of such permits shall be determined by the Town Manager or his or her designee.
      (4)   The fee to be paid for such permit shall be as established from time to time by the Board of Aldermen. Permits shall be effective for that portion of the calendar year that parking is regulated by meters.
      (5)   A vehicle properly displaying a current authorized permit shall be permitted to remain in a marked parking space without activating the meter or pay station. Provided that holders of contractor parking permits may not park in off-street parking lots or in on-street parking spaces providing a maximum meter time of one hour or less.
   (C)   Additional restrictions applicable to commercial and contractor permits.
      (1)   The business owner or operator or contractor or subcontractor to whom such permit is issued is authorized to permit such permit to be used by employees of such business. It shall be unlawful and a violation of this section for any person to permit use of such permit by any person other than an employee of the business and for any person to sell such permit or to accept anything of value in return for the use of such permit.
      (2)   Lost permits may be replaced upon payment of a fee of $600 and receipt of a sworn statement from the business owner or operator or contractor or subcontractor that such permit has been lost and not transferred or otherwise used in a manner not permitted by this section. No permit may be replaced more than once in any 12-month period.
      (3)   A violation of the provisions of this section (with the exception of division (C)(1)) above shall be deemed a violation of the provisions of § 74.40 of this code and shall subject the offender to a penalty as set forth in § 74.99 of this code. A violation of the provisions of division (C)(1) above shall subject the offender to a civil penalty in the amount of $500. Such penalty may be recovered by the town in a civil action in the nature of debt if the offender does not pay the penalty within ten days after having been cited for violation of the section. Each day’s continuing violation of any provisions of this section shall be a separate and distinct offense.
