(A) Violations of the provisions of this chapter shall subject the offender to a civil penalty as hereinafter enumerated or as established from time to time by the Board of Aldermen in the Budget Ordinance. These ordinances shall be referred to as parking ordinances. Civil penalties may be recovered by the town in a civil action in the nature of debt if the offender does not pay the penalty within the prescribed period of time after he has been cited for violation of the ordinance. In accordance with G.S. § 160A-175(b), a violation of the parking ordinances shall not be subject to the penalty provision of G.S. § 14-4 and shall not be considered a breach of the penal laws of the state.
(B) Penalties for overtime parking in a metered space and for all other violations of the parking ordinances shall be as set forth in Schedule IV of Chapter 76: Parking Schedules
(C) Any person violating the provisions of § 74.44 shall be subject to the following penalties:
(1) A violation of the provisions of this chapter is a misdemeanor punishable in accordance with the provisions of G.S. § 14-4. The fine for such violation shall not exceed $500;
(2) A violation of the provisions of this chapter shall subject the offender to a civil penalty of $500 (recommended);
(3) The provisions of this chapter may be enforced by an appropriate equitable remedy issuing from a court of competent jurisdiction;
(4) Each day's continuing violation of any provisions of this chapter shall be separate and distinct offense;
(5) Any person found guilty of a violation of § 74.44 shall lose their right to have issued a residential or commercial parking permit for a period of two years from the date of conviction. Providing, that within 30 days of such conviction, such person may request a hearing before the Town Manager at which time they will be given the opportunity to demonstrate to the Town Manager that their parking permit privileges should not be revoked for such period of time. The decision of the Town Manager in such matter shall be final.
