10-12-2: Vehicles Subject To Impoundment And Administrative Fee:
A motor vehicle may be towed and impounded, and an administrative fee may be imposed upon probable cause that any of the following violations have occurred, provided that the subsection hearings below are for general reference only, and shall not be deemed to be any limitation on the authority granted herein in accordance with specific references to a state law or laws:
   A.   Whenever the person or person in charge of such vehicle are unable to provide for its custody or removal pursuant to 625 ILCS 5/11-1302(c)(2); or
   B.   Whenever the person driving or in control of such vehicle is arrested for an alleged offense for which the officer is required by law to take the person arrested before a proper magistrate without unnecessary delay pursuant to 625 ILCS 5/11-1302(c)(3); or
   C.   DUI. Driving under the influence of alcohol, another drug or drugs, an intoxicating compound or compounds or any combination thereof in violation of 625 ILCS 5/11-501; or
   D.   Statutory Suspension, Operation or use of a motor vehicle or use of a motor vehicle during the statutory summary suspension of revocation in violation of 625 ILCS 5/11-501.1; or
   E.   Motor Vehicle Accident Involving Injury or Death. Operation of use of a motor vehicle in an accident involving death or personal injury in violation of 625 ILCS 5/11-401.
   F.   DWLS-DWLR. Operation or use of a motor vehicle while a driver's license, permit, or privilege to operate a motor vehicle is suspended or revoked pursuant to 625 ILCS 6-303; except that vehicles shall not be subjected to seizure or impoundment if the suspension is for an unpaid citation (parking or moving) or due to failure to comply with emission testing; or
   G.   No Valid DL. Operation or use of the motor vehicle without having a valid driver's license in violation of 625 ILCS 6-101 *** Expired less than one year is a petty offense
   H.   Aggravated Fleeing and Eluding. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 625 ILCS 11-204.1; or
   I.   Required Liability Insurance Policy. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 625 ILCS 5/7-601; or
   J.   Abandonment of Vehicles. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 625 ILCS 5/4-201; or
   K.   Outstanding Warrant. Operation or use of a motor vehicle or use of the motor while a warrant is outstanding for that driver of the motor vehicle.
   L.   Section 36-1 offense. Operation or use of a motor vehicle in the commission, or in the attempt to commit, an offense for which a motor vehicle may be seized and forfeited pursuant to 720 ILCS 5/36-1; or
   M.   First Degree Murder, Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/9-1; or
   N.   Involuntary Manslaughter/Reckless Homicide. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/9-3; or
   O.   Aggravated Kidnapping. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/10-2; or
   P.   Criminal Sexual Assault. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/11-1.20; or
   Q.   Aggravated Criminal Sexual Assault. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/11-1.30; or
   R.   Predatory Criminal Sexual Assault. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/11-1.40; or
   S.   Criminal Sexual Abuse. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/11-1.50(a); or
   T.   Aggravated Criminal Sexual Abuse. Operation or use of a motor vehicle or use of the motor vehicle in the commission of or in the attempt to commit an offense in violation of 720 ILCS 5/11-1.60; or
   U.   Indecent Solicitation of a Child. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/11-6; or
   V.   Promoting Juvenile Prostitution. Operation or use of a motor vehicle in the commission of an offense in violation of 625 ILCS 5/11-14.4; or
   W.   Child Pornography. Operation or use of a motor vehicle in the commission of, or in the attempt to commit, an offense in violation of 720 ILCS 5/11-20.1; or
   X.   Aggravated Battery. Operation or use of a motor vehicle in the commission of, or in the attempt to commit, an offense in violation of 720 ILCS 512-3.05 (a)(1), (a)(2, (a)(4), (b)(1), (b)(2), (e)(1), (e)(2), e(3), e(4), e(5), e(6), or e(7) ; or
   Y.   Stalking. Operation or use of a motor vehicle in the commission of, or in the attempt to commit, an offense in violation of 720 ILCS 5/12-7.3.
   Z.   Aggravated Stalking. Operation or use of a motor vehicle in the commission of, or in the attempt to commit, an offense in violation of 720 ILCS 5/12-7.4; or
   AA.   Scrap Metal Theft. Operation or use of a motor vehicle in the commission of, or in the attempt to commit, an offense in violation of 720 ILCS 5/16-1; or
   BB.   Retail Theft. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/16-25(f)(2), (3); or
   CC.   Armed Robbery. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/18-2; or
   DD.   Burglary. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/19-1; or
   EE.   Possession of Burglary Tools. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/19-2; or
   FF.   Residential Burglary. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/19-3; or
   GG.   Arson. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/20-1; or
   HH.   Possession of Explosives. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/20-2; or
   II.   Unlawful Use of Weapons. Operation of or use of a motor vehicle in the commission if, or in the attempt to commit an offense in violation of 720 ILCS 5/24-1; or
   JJ.   Aggravated Discharge of Firearm. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/24-1.2; or
   KK.   Aggravated Discharge of Machine Gun. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/24-1.2-5; or
   LL.   Reckless Discharge of a Firearm. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/24-1.5; or
   MM.   Gambling. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/28-1; or
   NN.   Possession of a Deadly Substance. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/29D-15.2; or
   OO.   Cigarette Tax Act Violations. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 35 ILCS 130/21, 22, 23, 24, 26, 28, 29, 30; or
   PP.   Improper Disposal of Hazardous Wastes per Environmental Protection Act. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 415 ILCS 5/44; or
   QQ.   Trafficking Persons. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/10-9; or
   RR.   Prostitution. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/11-14; or
   SS.   Solicitation of a Sexual Act. Operation or use of a motor vehicle or use of the motor vehicle in the commission of, or in the attempt to commit an offense in violation of 720 ILCS 5/11-14.1; or
   TT.   Property subject to forfeiture under Section 40 of the Illinois Streetgang Terrorism Omnibus Prevention Act, 720 ILCS 147/1. (Ord. 2023-40, 9-19-2023)
