AN ORDINANCE SETTING THE WAGE SCALE OF LATERAL APPOINTEES TO THE WORTH POLICE DEPARTMENT
 
   WHEREAS, the Village of Worth (“Village”) is a municipal corporation lawfully organized and existing under the Constitution and laws of the State of Illinois, including, without limitation, the Illinois Municipal Code (65 ILCS 5/1, et seq.) (“Code”); and
   WHEREAS, the Village of Worth Board of Fire and Police Commissioners (“BOFPC”) has recently passed an ordinance amending the BOFPC’s rules and regulations to allow the BOFPC to, among other things, appoint police officers who have maintained Illinois peace officer training and certification and who are experienced full time police officers from other Illinois jurisdictions with a minimum of two years of continuous active service as a police officer (“Lateral Hires”); and
   WHEREAS the current collective bargaining agreement between the Village and the Illinois Fraternal Order of Police Labor Council/ Worth Lodge No. 143 (“Union”) does not set forth the wages paid to Lateral Hires; and
   WHEREAS, the Village of Worth Board of Trustees is authorized to establish the wages paid to Lateral Hires and other conditions of employment and seeks to do so in this Ordinance; and
   WHEREAS, the Union has approved the wage scale for Lateral Hires set forth in this Ordinance;
   NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Worth, Cook County, Illinois, as follows:
   Section 1. RECITALS. The foregoing recitals are incorporated as though fully set forth herein.
   Section 2 . COMPENSATION OF LATERAL HIRES. At the time of their appointment Lateral Hires shall be paid at the pay step of a full time officer with two (2) years of experience on the existing wage scale set forth in section 31.1 of the current collective bargaining agreement between the Village and the Union (“CBA”). 
   Section 3. SENIORITY: Seniority for all Lateral Hires shall be determined based on the date of hire.
Section 4. PROBATIONARY PERIOD: Lateral Hires shall be considered a probationary employee as defined in Section 2.2 in the CBA.
   Section 5. SUPERSEDERAll ordinances, resolutions, and parts thereof in conflict with this Ordinance are hereby repealed to the extent and only to the extent they conflict with this Ordinance.
Section 6. SEVERABILITYIf any part, subsection or clause of this Ordinance shall be deemed to be unconstitutional or otherwise invalid, the remaining sections, subsections and clauses shall not be affected thereby.
   Section 7. EFFECTIVE DATEThis Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
