1311.01 BOARD OF BUILDING AND ZONING APPEALS.
The Board of Building and Zoning Appeals is hereby designated as the appeals board for any and all matters within the jurisdiction of the Division of Building Standards concerning the Minimum Housing Standards and Property Maintenance Code; one, two and three family dwellings, except as may be otherwise specifically designated by one or more of the codes and ordinances within such jurisdiction.

1311.02 APPEAL AND REVIEW; FEE.
Any person affected by a decision of the code official or a notice or order issued under any applicable code shall have the right to appeal such decision, notice or order, provided that the appeal is filed with the Division within twenty calendar days of the day on which the decision, notice or order was served. The application for appeal shall be based upon a claim that the true intent of the code or rules adopted thereunder has been incorrectly interpreted; or that the provisions of the code do not fully apply; or that the requirements of the code are adequately satisfied by other means. The Division shall transmit the file relating to the matter to the Board of Building and Zoning Appeals and shall be represented at the hearing of the appeal by a member of the Division as the Director may direct.
