945.03 COLLECTION AND DISPOSAL.
   (a)   Residential Disposal. All residential solid waste shall be collected and disposed of by the City or its contractor.

   (b)   Nonresidential Disposal. All solid waste and other waste from commercial, industrial, institutional and other nonresidential premises, including apartments and condominium complexes with three or more units, shall be collected and disposed of by persons, firms or corporations authorized to do so in accordance with the provisions of Section 945.08 , except that apartments and condominium complexes with three or more units which meet the definition at Section 945.01 (j) may, at the discretion of the Mayor or his/her designee, be included for purposes of residential disposal in subpart (a). No person, firm or corporation shall dump, allow to be dumped or permit construction waste, hazardous waste, infectious waste or solid waste to be dumped in the open, nor permit or allow solid waste to remain in containers uncollected for a period exceeding seven consecutive days.
      (1)   Notwithstanding the foregoing, entities located within the Central Business District are eligible to participate in the Downtown Waste Collection Program, by which waste collection receptacles will be placed at designated locations within the Central Business District and participants will be billed on a monthly basis for the use thereof Entities must apply to the mayor or his/her designee for participation in the program, and once approved, may place their solid waste for collection at one of the designated locations. Charges for this service will be established and collected in accordance with Section 945.07.
      (2)   Notwithstanding the foregoing, metered multi-family residential properties that are not individually metered and commercial businesses operating from residential-style or mixed-used residential buildings may, at the discretion of the Mayor or his/her designee, be included for purposes of residential disposal.    (c)   Individual Disposal. No person, firm or corporation shall dispose of solid waste in any quantity in any place, private or public, within the City limits or within not more than 5,000 feet outside of the City limits unless licensed to do so in accordance with the provisions of this chapter.
   (d)   Placing of Solid Waste and Recyclables for Collection; Maintenance of Containers.
      (1)   Solid waste and recycling bins from residential premises shall be placed at the street, curb, tree lawn, alley way or other collection location approved by the Mayor or his/her designee, except that apartments and condominium complexes with three or more units which meet the definition at Section 945.01(j) may be required to obtain a dumpster or other central collection device.
         A.   No person shall place solid waste or recyclables for collection any earlier than 4:00 p.m. on the evening before the day of collection. Neither will the City nor its contractor be liable for collection of solid waste that is placed for collection on the regularly scheduled day of collection, but after regular collection has occurred at that location.
         B.   No person shall place solid waste or recyclables for collection that was not actually generated at that service address.
      (2)   Solid waste and recycling bins shall be returned to the place of storage within twenty-four hours from the time of collection. Recycling bins remaining at the collection location after the time provided for herein may be removed by the City or its contractor.
      (3)   Solid waste and recycling bins shall be maintained in a safe and sanitary condition. In the event that containers are not so maintained, the Mayor or his/her designee or his duly authorized agent, shall notify the property owner to whom the bins were issued , and such owner shall repair, disinfect or replace the containers within three days of the receipt of such notice. If such containers are not placed in a sanitary and/or safe condition, the containers may be collected at the option of the City and either disposed of or rendered safe and returned to the owner. If rendered safe or repaired, the owner shall be charged a fee not to exceed the amount necessary to cover the actual cost of labor and materials.
