945.07 RATES FOR RESIDENTIAL COLLECTION AND DISPOSAL; NONPAYMENT.
   (a)   The owner, occupant or tenant of all residential premises shall pay a service charge to the City for the collection and disposal of solid waste. The City shall collect solid waste fees in the manner determined by the Mayor or his/her designee. The Mayor or his/her designee is authorized to set service charges at a level sufficient to meet the cost of collection plus related costs of administration. If any charges hereunder are not paid when due, the City may either certify the unpaid charges to the County Auditor for placement on the tax list and duplicate as a lien against the property served, or collect them by actions at law in the name of the City from an owner, tenant or other person who is liable for the unpaid charges.
   (b)   The City may refuse to collect solid waste from any premises where the owner, occupant or tenant is in arrears for a period of two months for charges assessed for the collection of solid waste. (Ord. 1995-37. Passed 10-2-95.)
