4.13.2: DEFINITIONS:
For purposes of this Chapter, the terms defined in the International Property Maintenance Code (IPMC), 2015 edition, as currently adopted with any amendments by the City, or any other International Property Maintenance Code edition, with or without amendments, as may be adopted by the City in the future, shall apply, except as otherwise indicated.
AFFILIATED BUSINESS ENTITY: Any entity that owns or controls rental units in the City that is under the ownership or control of an individual or business entity that owns or controls other rental units within the City, whether under the same or different business entity names. Entities subject to the Illinois Real Estate License Act shall not be treated as affiliated business entities when operating in their regulated capacity under that Act.
LOCAL CONTACT: A person, firm, or corporation designated by the owner of a rental unit to manage the rental unit on a day-to-day basis, and that is empowered to perform maintenance and repairs to any rental unit as necessary for compliance with this Code and applicable law. Designating a local contact does not relieve a rental unit owner from responsibility for compliance with all applicable City Codes or other responsibilities associated with ownership of a rental unit. The designated local contact must live within thirty (30) miles of the City, unless at least one rental unit owner satisfies this qualification. Any person thus representing the rental unit owner shall be bound to comply with the provisions of this chapter and the rules and regulations pursuant thereto, to the same extent as if they were the rental unit owner and must accept all service of notice on behalf of the rental unit owner.
RENTAL UNIT: Any residential property in the City that the owner thereof lets, either entirely or in part, to another person for occupancy as a dwelling unit, but excluding buildings, structures and uses registered and inspected by the State of Illinois or the federal government.
RENTAL UNIT OWNER: The rental unit owner is the person(s) who last paid property taxes on a rental unit, or the property in which the rental unit is located in the case of multi-unit buildings, as reflected in the tax records of the McHenry County Treasurer, unless updated ownership information has been provided to the City by the current property owner.
