3.24.4: APPLICATION:
All applicants for outdoor seating permits shall complete an application on a form provided by the City. An inspection of the property to document existing conditions of public improvements may be performed by the City prior to issuance of a permit. All applications shall include:
   A.   A dimensioned drawing showing the boundaries of the proposed outdoor seating area adjacent to the business, including any street lights, signs, planters, trees, tree grates, the curb, benches, railings or any other public appurtenances, and the proposed location of any tables, chairs, umbrellas, trash receptacles, host stands, fences, planters, barriers and any other equipment to be placed on the public right-of-way.
   B.   Prior to issuance of an outdoor seating permit, the permit holder shall provide the City with copies of the certificates of insurance for the required policies for each type of insurance naming the City as an additional insured party with respect to the public property or right of way on which the outdoor seating is located and the use and operation of such outdoor seating by permit holder. The required insurance policies shall each provide that they shall not be changed or cancelled during the life of the outdoor seating permit until thirty (30) days after written notice of such change has been delivered to the City.
      1.   Worker's Compensation Insurance in at least the required statutory limits.
      2.   Commercial General Liability: Commercial General Liability occurrence insurance with a limit of not less than one million dollars ($1,000,000.00) for each occurrence and two million dollars ($2,000,000.00) in the aggregate. The policy shall include coverage at least as broad as Insurance Service Office policy form CG 00 01 or any replacement thereof. The certificate of insurance for the Commercial General Liability insurance policy shall expressly cover the obligations of indemnification required by the City Manager or their designee. These limits may be met through a combination of primary and excess liability coverage.
      3.   Umbrella Liability Insurance with limits of at least two million dollars ($2,000,000.00) per occurrence.
      4.   Liquor Liability Coverage for any establishment serving alcohol on public property.
   C.   A signed indemnification statement indemnifying and holding the City harmless for the applicant's use of the outdoor seating area, on a form provided by the City. (Ord. 23-O-15, 2-21-2023)
