(a) For the purposes of this chapter the following words and phrases shall have the following meanings ascribed to them respectively.
(1) "Accessory building" means a subordinate building located on a lot containing a main building and the use of which is customarily incidental to that of the main building.
(2) "Apartment house" means a building designed and used as a residence by three or more families living independently of each other; or by three or more individuals or groups of individuals living independently. A residential building containing a use other than a dwelling use or an area designed for such other use, excluding home office uses approved in sections of the Planning and Zoning Code, shall be considered an apartment house. The words "apartment house" and "multiple dwelling" are synonymous.
(3) "Approved" means approved by the Building Inspector pursuant to rules and regulations adopted pursuant to Section 1317.12 or approved by any other person or board designated by the ordinances of the Village to give approval to the matter in question.
(4) "Available" means where a service or facility is provided and is accessible to a property without the need for crossing the private property of another.
(5) "Basement" means a space with a floor level two feet or more below adjoining ground, but having less than one-half its clear height below adjoining ground. A basement shall be deemed a story when the ceiling is more than four feet six inches above adjoining ground.
(6) "Building" means any structure designed, built or occupied as a shelter or enclosure for persons, animals or property of any kind.
(7) "Building Inspector" means the Building Inspector of the Village, and when used herein, shall be construed as though followed by the words "or his authorized assistant, agent or representative."
(8) "Cellar" means a space having one-half or more of its clear height below adjoining ground.
(9) "Clear height" means the distance between a finished floor level and the floor joists of the level above.
(10) "Commission" means the Planning and Zoning Commission of the Village.
(11) "Dwelling" means a building designed and occupied as a residence by not more than two families living independently of each other and doing their own cooking upon the premises.
(12) "Dwelling structure" means a building or structure used or designed to be used, all or in part, for residential purposes.
(13) "Dwelling unit" means a room or a group of rooms arranged, maintained or designed to be occupied by a single family for living, sleeping, cooking and eating. The words "dwelling unit" can mean "apartment" or "suite".
(14) "Family" means one individual or a number of individuals related to the nominal head of the household, living as a single housekeeping unit in a single dwelling unit, but not including persons other than the following:
A. Husband or wife of the nominal head of the household;
B. Son or daughter of the nominal head of the household or of the spouse of the nominal head of the household, and the dependent children of such son or daughter;
C. Father, mother, grandfather or grandmother of the nominal head of the household or of the spouse of the nominal head of the household;
D. Dependent brother or sister of the nominal head of the household or of the spouse of the nominal head of the household, which brother or sister is not living with his or her spouse, and his or her dependent children.
(15) "Finished livable floor area" means the sum of the floor area completed for year-round use. The floor area occupied by the heating plant, the water heater, or the incinerator shall be excluded in computing finished livable floor area.
(16) "Foundation" means the supporting portion of a structure below the first floor construction or ground, including the footings.
(17) "Grade level" means the mean elevation of the ground adjoining a main building or structure on all sides.
(18) "Habitable room" means a room or enclosed floor space used or intended to be used for living, sleeping or eating purposes.
(19) "Housing" is synonymous with the term "dwelling structure".
(20) "Multiple dwelling" means a building containing three or more dwelling units, or two or more units above the first or ground floor, or one or more dwelling units if the building contains a use other than a dwelling use. The words "multiple dwelling" and "apartment house" are synonymous.
(21) "Occupant" means a person living, sleeping, cooking or eating in, or having actual possession of, a dwelling unit or a room.
(22) "One and one-half story dwelling" means a dwelling with floor areas on two levels, one above the other, connected by stairs with the ceiling area of the upstairs smaller than the floor area of the downstairs, and at least seven and one-half feet above the upstairs floor.
(23) "One-story dwelling" means a dwelling containing no livable floor area in the second story thereof.
(24) "Operator" means a person who has charge, care or control of a dwelling structure.
(25) "Owner" means the owner or owners of the premises, including the holder of title thereto subject to contract or purchase, a vendee in possession, a mortgagee or receiver in possession, a lessee or joint lessees of the whole thereof, or an agent or any other person, firm, corporation or fiduciary directly in control of the premises.
(26) "Premises" describes a lot, parcel or plot of land including the building or structures, landscaping and trees thereon.
(27) "Split-level dwelling" means a dwelling containing floor area on two or more levels with not less than six feet vertical distance between the plane of one floor level and the plane of the next higher floor level.
(28) "Supply" or "supplied" means paid for, furnished, or provided by or under the control of the owner or operator.
(29) "Two-story dwelling" means a dwelling with livable floor area on the first and second stories of the dwelling unit.
