§ 880.10 FAILURE TO FILE RETURNS OR PERMIT EXAMINATION OF RECORDS; ESTIMATED ASSESSMENTS; SURCHARGE ON UNPAID TAX.
   (a)   If a person whose duty it is to collect and/or pay the tax imposed by this chapter neglects or refuses to file any return required by this chapter or, having tendered a return, neglects or refuses to pay the amount of tax imposed by this chapter as shown by such return, the Director of Finance shall make an estimated assessment of the probable amount of the tax payable by such person, to which shall be added a penalty of ten percent of the amount assessed. The Director of Finance shall promptly thereafter give or send by mail a notice of such estimated assessment and penalty to the person against whom such assessment and penalty has been made.
   (b)   The Director of Finance may make an estimated additional assessment, to which shall be added a penalty of ten percent of the assessment, against any person who files any return as required by this chapter but who refuses to permit the Director of Finance or a duly authorized deputy to examine his or her books of account and papers pertaining to the business for which the return was made. The Director of Finance shall promptly thereafter give or send by mail a notice of such estimated additional assessment and penalty to such person, together with written notice of the time when and the place where such person may be heard on a petition for reassessment, as provided in this chapter.
