§ 1480.99 PENALTY.
   (a)   Violation penalties. Any person, being the owner, agent, or having control of any building or premises, who violates any provision of this Property Maintenance Code, or fails to conform to any provision thereof, or fails to obey any order of the Building Commissioner/Inspector or his or her duly authorized agent, shall be guilty of a minor misdemeanor. However:
      (1)   Whoever is convicted or pleads guilty of a second offense not sooner than 20 days and not later than one year of the same section of the Property Maintenance Code shall be charged with a misdemeanor of the fourth degree.
      (2)   Whoever is convicted or pleads guilty of the third offense not sooner than 20 days and not later than one year of the same section of the Property Maintenance Code shall be charged with misdemeanor of the third degree.
      (3)   Whoever is convicted or pleads guilty of the fourth offense not sooner than 20 days and not later than one year of the same section of the Property Maintenance Code shall be charged with misdemeanor of the second degree.
      (4)   Whoever is convicted or pleads guilty of the fifth offense not sooner than 20 days and not later than one year of the same section of the Property Maintenance Code shall be charged with misdemeanor of the first degree.
   (b)   Each and every day on which such person continues to violate any provision of the Property Maintenance Code after having once been notified of such violation shall constitute a separate offense.
   (c)   Abatement of violation. The imposition of the penalties herein prescribed shall not preclude the Village from taking such appropriate action as permitted by law to restrain, correct or abate a violation, or to prevent illegal occupancy of a building, structure or premises, or to stop an illegal act, conduct, business or utilization of the building, structure, or premises.
