§ 1026.07 PLANTING OR REMOVAL: PERMIT REQUIRED; CONDITIONS FOR DENIAL.
   (a)   No person shall plant or remove any tree or shrub upon a public way, curb strip, street, alley, Municipal Park or other public right-of-way without first obtaining a permit therefore, in writing, specifying the size, type, species and location of the tree or shrub to be so planted or removed.
   (b)   The Board may deny a permit to any person who proposes to plant any tree or shrub upon a public way, curb strip, street, alley, Municipal Park or other public right-of-way of a size, type or species found by the Board to be undesirable for the location proposed, or may deny a permit to any person who proposes to plant any tree or shrub upon a public way, curb strip, street, alley, Municipal Park or other public right-of-way at a location found by the Board to be of a size or type unsuitable for the planting of trees or shrubs.
