ADOPTING ORDINANCE
ORDINANCE NO. 2005-17
   AN ORDINANCE ESTABLISHING A CODE OF ORDINANCES FOR THE COUNTY OF WOODFORD, REVISING, AMENDING, RESTATING, CODIFYING, AND COMPILING CERTAIN EXISTING GENERAL ORDINANCES OF THE COUNTY DEALING WITH SUBJECTS EMBRACED IN THE CODE
   WHEREAS, the present manner of arrangement, classification and indexing of the general ordinances of the County of Woodford is insufficient to meet the immediate needs of the County; and
   WHEREAS, the Acts of the General Assembly of the Commonwealth of Kentucky empower and authorize the Fiscal Court of Woodford County to revise, amend, restate, codify and to compile any existing ordinances and all new ordinances not heretofore adopted or published and to incorporate the ordinances into one ordinance in book form; and
   WHEREAS, the Woodford County Fiscal Court has authorized a general compilation, revision and codification of the ordinances of the County of a general and permanent nature and publication of such ordinances in book form;
   NOW, THEREFORE, BE IT ORDAINED by the Fiscal Court of the County of Woodford, Commonwealth of Kentucky, as follows:
   Section 1. The general ordinances of the County of Woodford as herein revised, amended, restated, codified, and compiled in book form are adopted as and shall constitute the "Code of Ordinances of the County of Woodford."
   Section 2. The Code as adopted in Section 1 shall consist of the following titles:

   Section 3. All prior ordinances pertaining to the subjects treated in the Code and in conflict therewith shall be deemed repealed from and after the effective date of the Code, except as they are included and reordained in whole or in part in the Code; provided that such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of the Code, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements or plats, accepting dedications of land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Code, or inadvertently omitted from the Code.
   Section 4. The Code shall be deemed published as of the day of its adoption and approval by the Woodford County Fiscal Court, and the Fiscal Court Clerk is hereby authorized and ordered to file a copy of the Code in the Office of the Woodford County Clerk, and in the Woodford County Judge/Executive's office.
   Section 5. The Code shall be in full force and effect from and after its date of passage, approval and publication as required by law. The Code shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties and regulations therein contained, and of the date of passage, and that the same is properly signed, attested, recorded and approved, and that any public hearings and notices thereof as required by law have been given.
   Section 6. Ordinances approved and adopted subsequent to the passage of this code establishment ordinance shall be of full force and effect even though not contained in the current code. Failure to include any such later-passed ordinance in an amended Code of Ordinances shall, in and of itself, not serve to repeal, revoke, or otherwise render null and void such ordinance(s).
   Introduced and given first reading at a regular meeting of the Woodford County Fiscal Court on November 8, 2005, and fully adopted after the second reading at the regular meeting of Woodford County Fiscal Court on December 13, 2005. This Ordinance shall take effect and be in full force when passed, published and recorded according to law.
