(A) Generally. Generally, Woodford County believes in the application of progressive discipline. However, the county reserves the right to skip any step or requirement in the disciplinary action sequence outlined below, depending on the severity of the misconduct or when the facts or circumstances otherwise warrant. Further, it is also noted that in establishing the following disciplinary procedures it is specifically not the county’s intention to create any employment situation that compromises its at- will employment status. As expressly stated that in this chapter’s Statement of Purpose in § 36.001, nothing in these policies is intended to create a contract of employment.
(B) Common infractions. The following is a list of common infractions. While this list does not include all actions that call for disciplinary action, it is intended as a guide to assist in avoiding activities that are in conflict with the principles and goals of an efficient work force:
(1) Absenteeism, lateness;
(2) Gambling while on duty;
(3) Abuse of sick leave;
(4) Insubordination;
(5) Theft of county property;
(6) Leaving work without authorization;
(7) Intoxication or use of intoxicants or drugs while on duty;
(8) Reporting to work under the influence of drugs or alcohol;
(9) Unauthorized use of county vehicles;
(10) Provoking or inciting a fight, or fighting during work hours;
(11) Mistreatment (physical or verbal) of citizens;
(12) Use of profanity in the presence of citizens or other employees;
(13) Willful neglect or abuse of county property;
(14) Deliberate falsification of time records;
(15) Harassment, including sexual harassment; or
(16) Violation of any local, state or federal ordinance, statute or law.
