§ 154.298 PROCEDURE FOR DECISION.
   The Planning and Zoning Board shall review the site development and provide its recommendation to the Village Board, who shall then take final action in the plan. Site development plans for the CBD Central Business District shall be approved under the following procedure.
   (A)   Planning and Zoning Board recommendation. Within 30 days of the date the site development plan first appears on the agenda of the Planning and Zoning Board for action, the Planning and Zoning Board may vote to recommend approval or denial of the site plan by a majority of those Planning and Zoning Board members present and voting. If the Planning and Zoning Board fails to vote within 30 days after the item has first appeared on the Planning and Zoning Board agenda, the Board shall be deemed to have recommended denial, unless such date is extended and mutually agreed upon by the applicant and the Planning and Zoning Board.
   (B)   Village Board action. The Village Board shall approve, approve with conditions, or deny the site development plan. Approval shall be made by adoption of an ordinance authorizing such site development plan, and any conditions thereon.
   (C)   Criteria for plans. In reviewing and determining whether to approve or disapprove a site development plan, the Planning and Zoning Board shall consider the criteria listed below, as appropriate.
   (D)   Conformance with ordinances. The application shall comply with the provisions of § 154.078 and this subchapter and other ordinances of the village and of any other applicable laws.
   (E)   The Director of Community Development (Director) shall approve a site plan for parcels within DT districts if the site plan complies with all requirements of the village's zoning ordinance. If the Director denies approval of a site plan, the denial may be appealed by the applicant to the Planning and Zoning Board for review. The Planning and Zoning Board shall then approve the site plan, approve the site plan with conditions, or deny the site plan.
