§ 150.005 TEMPORARY CERTIFICATES OF OCCUPANCY.
   (A)   It is the policy of this village to avoid issuance of temporary certificates of occupancy (“CO”) because of the problems inherent with them, mainly involving circumstances where the completion of the work on the building or grounds is not completed on a timely basis following issuance of the CO.
   (B)   Wintertime temporary CO’s will be issued from November 1 through April 1 provided that landscaping (NOT final grading) is the only remaining part of the construction awaiting completion. Any wintertime temporary CO shall require posting of a $5,000 landscaping bond, and all work shall be completed not later than the next following May 31.
   (C)   Special temporary CO’s will be issued from April 2 through October 31 only when all of the following conditions apply:
      (1)   The only remaining work is landscaping (NOT final grading);
      (2)   A $5,000 landscaping bond is posted;
      (3)   All remaining landscaping work shall be completed within 30 days of the issuance of the temporary CO; and
      (4)   The delay in completion is a result of inclement weather, not the fault of the owner or builder of the structure.
   (D)   The determination of whether landscaping is the only remaining construction shall be made by the Village Engineer, and the applicant shall pay any fees that the Engineer may charge for the review and determination.
   (E)   The landscaping bond shall be in the form of a check made payable to the village drawn on good funds. The village will deposit the landscaping bond check upon receipt. Provided that the landscaping work is completed within the time permitted, the bond shall be refunded. However, if the work is not completed on time, the bond is forfeit. The village shall then complete the landscaping, and if the amount of the bond is insufficient to cover the expense of the same, it shall have the right to bill the builder, homeowner, or contractor to recover any such additional expenses it shall incur.
   (F)   The village shall charge an administration fee in the amount of 2% of the escrowed funds each time an escrow is established, which funds shall be collected at the time that the escrow is established.
   (G)   Nothing herein shall affect the other requirements for a CO, including those set forth in § 150.004 of this code.
