Any act, the commission of which constitutes a misdemeanor under the laws of the state, is prohibited within the town, and any prohibited act, if committed within the town, shall constitute a violation of this code; provided, however, that the penalty for the offense committed shall not exceed the penalty prescribed in § 10.99.
