A. Tree replacement encouraged. The Director shall encourage, but not require, tree replacement with one or more new trees if the Director determines that:
1. a protected tree is dead or dying due to natural causes;
2. a protected tree is diseased;
3. a protected tree is likely to die or become diseased because it has been damaged or injured by one or more natural causes;
4. a protected tree has become a hazard to persons or property due to one or more natural causes; or
5. removal of a protected tree is consistent with good forestry practices or will enhance the health of remaining trees within the immediate vicinity.
B. Tree replacement required. The Director shall require tree replacement with one or more new trees if the Director determines that:
1. removal of a protected tree is necessary to avoid or alleviate a practical difficulty or particular hardship on the property or residence;
2. a protected tree has been removed without obtaining a permit pursuant to this chapter; or
3. a person has damaged or injured a protected tree by cutting, breaking, injuring, destroying or undertaking any procedure that causes, or is likely to cause the death, disease or substantial destruction of the protected tree without first obtaining a permit pursuant to Section 15.28.040 of this chapter.
