Section 15.28.040   Tree Removal Regulations
   A.   Tree removal permits required. Unless otherwise specifically authorized in this code, it is unlawful for any person to remove, cut, break, otherwise injure or destroy, or undertake any procedure that may cause the death or substantial destruction of any protected tree without first obtaining a tree removal permit from the Village.
   B.   Application for tree removal permit. All applications for tree removal permits shall be submitted to the Director by the owner of the property on which the subject tree is located. The application shall be submitted on forms to be provided by the Village.
   C.   Standards for issuance of tree removal permits. The Director shall not issue a permit for the removal of a protected tree unless he finds that removal of the tree is consistent with the stated policy and purpose of this chapter; provided, that all permits for the removal of elm trees, elm wood, ash trees and ash wood that are nuisances under the provisions of Chapter 8.20 of this code, shall also be subject to the standards established in that chapter, regardless of the size of the tree. Grounds for removal of a protected tree may include, but shall not be limited to, the following:
      1.   the tree is dead, or dying;
      2.   the tree is diseased;
      3.   the tree is damaged or injured to the extent that it is likely to die or become diseased, or to become a hazard to persons or property;
      4.   the tree constitutes a hazard to persons or property;
      5.   removal of the tree is consistent with good forestry practices;
      6.   removal of the tree will enhance the health of remaining trees within the immediate vicinity; or
      7.   removal of the tree will avoid or alleviate a practical difficulty or particular hardship on the property or residence.
   D.   Permit conditions. Any tree removal permit may include a requirement that the owner plant replacement trees if the Director, in the exercise of his discretion, determines either that replacement is specifically required by this chapter or that replacement is necessary and appropriate to implement the stated policy and purpose of this chapter.
