Section 10.28.100   Truck Traffic
   A.    It is unlawful for any person to operate any truck or other commercial vehicle having a gross weight in excess of two and one-half (2 ½) tons on any street under the jurisdiction of the Village, between the hours of midnight and 5:00 a.m. However, any truck or other commercial vehicle having a gross weight in excess of two and one-half (2 ½) tons carrying goods, merchandise or other articles to or from any commercial premises within the Village may enter upon such street, solely for the purpose of delivering or receiving goods, merchandise or other articles at a commercial premises within the Village; provided that, there is no other route available on which truck traffic is permitted during those hours and that the truck travels on such street for the shortest distance necessary to travel to or from the commercial premises in the Village or to or from a route on which truck traffic is permitted. In doing so, the driver of the vehicle shall proceed no further than is necessary for such purpose upon any street upon which trucks are prohibited.
   B.   The provisions of this section do not apply to:
      1.   any fire or emergency apparatus owned or operated by the Village or any other governmental body;
      2.   any vehicle owned or operated by or on behalf of the Village.
      3.   any vehicle operated under the terms of a special permit issued under Section 15-301 et seq. of the Illinois Vehicle Code.
