Section 5.09.300   Violations and penalties.
   A.   Except as provided in subsection B, any person who sells alcoholic liquor at any place within the Village without having a current valid license to do so issued under the provisions of this chapter, or who shall make any false statement or otherwise violate any of the provisions of this chapter in obtaining any license under this chapter, or who shall violate any other provisions of this chapter, or who, having obtained a license under this chapter, shall violate any of the provisions of this chapter or of the restrictions of such license with respect to the possession or sale of alcoholic liquor or to the maintenance of the licensed premises, shall for a first offense be fined not less than one hundred fifty dollars ($150.00) nor more than seven hundred fifty dollars ($750.00), and for a second or subsequent offense shall be fined not less than two hundred fifty dollars ($250.00) nor more than seven hundred fifty dollars ($750.00). Any fine imposed pursuant to this section may be in addition to or in lieu of the revocation or suspension of any license issued under the provisions of this chapter.
   B.   Any person who violates Section 5.09.260 or 5.09.270 of this chapter shall be subject to a fine of not less than two hundred fifty dollars ($250.00) nor more than seven hundred fifty dollars ($750.00). Any fine imposed pursuant to this section may be in addition to or in lieu of the revocation or suspension of any license issued under the provisions of this chapter.

   D.   Every act or omission of whatsoever nature constituting a violation of any of the provisions of this chapter, by any officer, director, manager or other agent or employee of any licensee shall be deemed and held to be the act of such employer or licensee, and such employer or licensee shall be subject to fines and penalties as if such act or omission had been done by him or her personally.    E.   Each day on or during which any person violates any of the provisions of this chapter shall constitute a separate offense.
