A. The following sections are amended as indicated:
Section 101.1 - Title: Insert the name village of Winfield as the name of the jurisdiction.
Section 101.6 of the following Use Permits:
1. All buildings except one-and two-family dwellings and town/row housing are required to have a Certificate of Occupancy issued by the Building Official verifying that it meets the requirements of the Fire Code.
2. No Certificate of Occupancy shall be issued unless the building is in conformance with the requirements of the Fire Code.
3. The Certificate of Occupancy shall be required for all existing buildings in accordance with paragraph 1 above.
4. A Certificate of Occupancy shall be required for buildings which change use, and special hazards controlled by this Code, added to or remodeled or altered.
5. The Certificate of Occupancy shall expire annually from the date of issuance and may be renewed if buildings are maintained in conformance with this Ordinance.
6. Where Special Permits are required, application shall be made to the Fire and Building Code Official. He/she shall determine criteria, limitations and duration of Permits and shall not issue Special Permits until the appropriate requirements are met.
Section 103: Department of fire prevention is repealed in its entirety and the following provided in its place:
Section 103 - Fire Code Enforcement Function
103.1 - Fire Code Enforcement Function Established: The function of the administration of fire code is established under the office of the village manager. Whenever this code refers to fire code official it is referring to the village manager or designee.
103.2 - Appointment: The village manager, subject to the approval of the president and village board may appoint a chief building official, or enter into a contract with a professional services firm capable of building code enforcement.
103.3 - Deputies: The village manager may designate other qualified employees, agents or contractors to assist in the enforcement of the fire code, in accordance with hiring or procurement practices of the village.
104.11.4 Add the following: Emergency conditions:
When in the opinion of the Fire Code Official and the Building Code Official, there is actual and immediate danger because of hazardous conditions which endanger life of may cause adverse effects upon adjoining properties, the Building Department may order the building to be immediately vacated and cause immediate remedial action if necessary. The cost of such remedial action shall be borne by the owner of the premises.
108.4 Add the following section:
Whenever the Fire Code Official and the Building Code Official shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision per Section 9-1-6-2 of this Title.
Amend section 109.03 - Violations/Penalties: To read:
See section 9-1-6-3, "Violations And Penalties", of the village code.
Amend section 109.4.2 - Penalties:
See section 9-1-6-3, "Violations And Penalties", of the village code.
Section 507.5.7 Add the following: Water main system: All buildings or structures over 10.000 square feet or a High Hazard Occupancy will require the water main to be looped around the building. The complete installation shall comply with all other Village of Winfield requirements.
Section 903.4.2 and 907.6.5.3 Monitoring: Add the following: All sprinkler and fire alarm systems shall be monitored per Chapter 9 of this Title.
903.2 Delete the following sections 903.2-903.2.10 and insert the following: All use groups shall have an automatic fire sprinkler system.
Exception: If all the following are met, fire sprinklers will not be required:
1. Building area less than 1,500 square feet;
2. Building is not used for sleeping;
3. Building has less than the Maximum Allowable Quantity for hazardous or flammable materials;
4. Building has no areas below grade or above the first floor;
5. Building is not continuously occupied during normal business hours;
6. Building is more than 30 feet from the principle building;
7. Section 905.3.8 Add the following:
Horizontal standpipe systems shall be provided within buildings where any part of the building interior is over one hundred fifty (150) feet from a point where motorized fire apparatus may stop during emergency fire operations.
Interior hose lines may be eliminated in buildings three (3) or less stories in height at the discretion of the local fire department.
907.2.14 Add the following:
All building except one- and two-family dwellings and townhouses shall be equipped with an automatic fire alarm systems with smoke detection.
1008.3.5 Insert the following:
Required stairways, hallways, and other means of egress including exterior open spaces to or through which exit ways lead shall be adequately lighted at all times that the building served thereby is occupied. Power supplied shall be from and approved, unfailing, reliable source separate from that providing normal power supplies to the building.
1013.1 Add the following:
a. In rooms accommodating more than 50 persons required exit doorways shall be plainly marked by approved exit signs sufficiently illuminated when the floor area is occupied, to be readily distinguished.
b. Where exit doorways are not visible from all locations, illuminated directional signs as required by the Bureau of Fire Prevention, shall be placed on walls or otherwise displayed in conspicuous locations to direct occupants to exit doorways.
Amend section 111.4 - Failure To Comply: To read:
Any person who shall continue any work on the system after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition shall be subject to penalties and fines found in section 9-1-6-3, "Violations And Penalties", of the village code.
5001.6.4 Add the following: Transportation of hazardous materials: The route used to transport hazardous materials explosives through the municipality shall be approved by the Fire Chief.
5601.1 Add the following sentence: The storage of explosives or blasting agents is not allowed within the corporate limits without a special permit.
5601.1.6 Transportation of explosives: Add the following: The route used to transport explosives through the municipality shall be approved by the Fire Chief.
5701.1 Add the following sentence: The storage of flammable liquids above ground is not allowed within the corporate limits without a special permit.
5704.2.9.6.1. 5706.2.4.4 5806.2 and 5806.2 Not allowed without a special use permit.
