8-4-7: UNLAWFUL USE OF WATER:
   A.   It shall be unlawful for any person to take or cause to be taken, either directly or indirectly, any water from the water mains without having first obtained lawful authority and permission so to do, by a strict compliance with all the provisions and requirements of this chapter relative thereto; and the taking, using and obtaining any water from the mains without first having authority and permission so to do, by a compliance with the provisions and requirements of this chapter, shall be and does constitute an offense and subjects any person so offending to the penalty provided in section 13-1-3 of this Code; provided, that the taking of any water from any fireplug to be used in extinguishing any fire shall not be considered an unlawful taking of water under this subsection.    B.   No person shall take water from any fireplug or hydrant connected with the Winfield waterworks system, nor shall any person open any such fireplug or hydrant for the purpose of taking water or for any purpose without a permit unless such person is an employee of the Village or is a member of the Winfield Fire Protection District or other personnel from an authorized fire department/district, and is acting in the discharge of his duties as such. There shall be a permit required and an administrative fee of fifty dollars ($50.00) for an entity to utilize the Village's water. The Village shall operate the valves, hydrants, etc., at all times.
Any person who shall violate any of the provisions of this subsection shall, for the first offense, be fined not less than twenty five dollars ($25.00) nor more than two hundred dollars ($200.00) or imprisoned for not more than ten (10) days or both; and for any subsequent offense, shall be fined not less than fifty dollars ($50.00) nor more than two hundred dollars ($200.00) or imprisoned for not to exceed thirty (30) days or both.
