4-2-7: ANTISCAVENGER ORDINANCE:
   A.   Definitions:
 
RECYCLABLE MATERIAL:
When used in this section, this term shall mean and include:
Aluminum beverage cans, and bimetal cans.
Paper products, consisting of newsprint, high grade wastepaper, mixed office wastepaper, and corrugated containers.
Glass bottles and jars consisting of clear, green, and brown color.
Plastics, consisting of polyethylene terephthalate (PET), high density polyethylene (HDPE), vinyl/polyvinyl chloride (PVC), low density polyethylene (LDPE), polypropylene, and all other resins and layered multimaterial.
SCAVENGER:
When used in this section, this term shall include every person, firm, or corporation that shall engage in the business of buying, selling, bartering or exchanging, or that shall collect, receive, store, or hold in possession for sale, barter or exchange any of the things defined herein as recyclable materials.
 
   B.   Restrictions:
      1.   It shall be unlawful for any scavenger to rummage through any items placed for collection by the Village’s refuse collector so as to cause, permit, or suffer any of said items, including, but not limited to, garbage or offensive substances, to be scattered about, or to remain at the location at which they were placed for collection by the Village’s refuse collector.
      2.   It shall be unlawful for any scavenger to collect, obtain, possess, rummage through or pick up any recyclable item placed for collection as part of the Village’s recycling program. (Ord. 90-10-3, 10-25-1990)
