3-1-1: DEFINITIONS:
The following definitions shall apply in the interpretation and enforcement of this chapter:
FOOD STORE: Any place where food or drink is prepared, handled, stored, offered for sale, or sold at wholesale or retail.
HAWKER: A "peddler", as defined herein, who cries his wares or goods or exhibits them for sale.
ITINERANT MERCHANT: A person who, for a short period of time, locates in a municipality and makes a sale and delivery of their goods or wares, or who carries his goods or wares from place to place and makes sales and delivery of those goods or wares. The term includes those persons who sell food or drink from locations that don't otherwise qualify as a food store or temporary restaurant service facility.
PEDDLER: A person who travels about selling small wares or goods which he carries with him. The term does not include a person who just carries samples and takes orders, but does include those persons who sell food or drink from locations that don't otherwise qualify as a food store or temporary restaurant service facility.
RESTAURANT OR FOOD SERVICE FACILITY: An eating or drinking establishment or place in which food or drink is prepared for sale for human consumption on or off the premises.
TEMPORARY RESTAURANT OR FOOD SERVICE FACILITY: A restaurant or food service facility operating for a temporary period in connection with a fair, carnival, circus, public exhibition, or similar gathering for no longer than four (4) days in succession.
