§ 95.99 PENALTY.

   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.

   (B)   A property owner that is determined by the Tree Board as being in violation of §§ 95.01 through 95.15 shall be subject to a fine not to exceed $500 for each offense. The amount of the fine shall be recommended by the Tree Board and approved by the City Council.

   (C)   (1)   Any person violating § 95.30 shall be fined not less than $50 nor more than $100 for each offense. Each day’s continued violation shall constitute a separate offense.

      (2)   In addition to the foregoing, § 95.30 may be enforced by civil penalty as provided in § 10.99.

   (D)   In addition to the foregoing, §§ 95.30 through 95.34 may be enforced by civil penalty as provided in § 10.99, which civil penalty shall not be less than $50 a day, with each day a violation exists or continues deemed a separate and distinct offense, and a separate civil penalty may be imposed for each such day.
