5-3-3: PARKING CITATIONS:
Pursuant to Idaho Code 50-3-15A and Rule 14(c)(1) OF THE Idaho Supreme Court Rules of Procedure in Traffic Cases, the following procedure is hereby adopted to ensure efficient disposition and enforcement of laws, ordinances and regulations governing the parking of vehicles within the city.
In lieu of citing a violator of vehicle parking regulations in District Court, any Lewis County sheriff or his deputies may issue a citation in the form hereinafter provided.
Any person accused of a violation of an ordinance prohibiting parking a vehicle in a designated area or restricting the length of time a vehicle may be there parked, may settle and compromise the claim against him or her for such illegal parking by paying to the city a bond in the sum of five dollars ($5.00) within five (5) days of the time such citation was issued. Any Lewis county sheriff or his deputies is hereby authorized to refrain from instituting prosecution for the alleged offense involved so long as compliance is had with the procedures herein.
The citation used for parking violations shall consist of at least two parts, assembled so the entries on the citation shall reproduce on the other part of the parts by carbon paper or other means. Each of the parts shall contain, as a minimum, space to write the date, time and location of violation, the violation by a brief description, the ordinance or statute number, the vehicle description, the registration, plate number and state, the Lewis County Sheriff or his deputies' signature and the last permissible day for posting bond. In addition, the citation shall be serially numbered and shall contain a certification that the Lewis County Sheriff or his deputy has reasonable grounds to believe the offense was committed and contain a notice to the violator that a complaint can be filed in the District Court in the event of noncompliance.
This section shall not apply to persons parking a vehicle so as to obstruct the entrance or exit of any place where police or fire apparatus or other emergency equipment is kept or housed. Nor shall this section apply to any person charged with parking in such a way as to reduce traffic on an arterial street to one-way traffic only; nor to any person whose parking creates an immediate hazardous traffic situation, nor to any person who refuses to move an illegally parked vehicle at the request of any Lewis County Sheriff or his deputies.
In all cases where a citation has been issued pursuant to this section, the issuing Sheriff or deputy shall cause a formal complaint to be filed in the District Court pursuant to state law and court rules when:
   A.   The violator has failed to post bond, or
   B.   The violator makes a request of Lewis County Sheriff or his deputies that the matter be so handled, which request must be made within five (5) working days of the violation and before bond has been posted.
All moneys paid by a violator pursuant to the section shall be paid to the District Court.
