A. The fees, rates and charges for collection of garbage and refuse within the City are hereby fixed and determined to be those charges set forth in that certain contract between the City of Winchester and Walco, Inc., dated January 1, 1991, any amendments duly made hereafter to that contract, or any subsequent contract for solid waste disposal that shall hereafter be made and shall hereafter be in force.
B. Provided, however, that where the enforcement of the provisions of this chapter will work a financial hardship, or where the garbage and refuse is of such small amounts as to not warrant the collection of the full fees and charges as provided by this chapter, the City Council may issue a special permit altering the provisions or this chapter and the fees and rates herein set forth.
